By accessing this website or placing an order, you acknowledge that you have read, understood, and agree to these Terms of Service.

1. Overview

Lift Wash Systems (“Company,” “we,” “us,” or “our”) operates this website and sells marine wash-down and lift-maintenance products. These Terms, together with our Return & Refund Policy and Privacy Policy, govern your use of the website and purchases.

2. Eligibility and Account Responsibility

You represent that you are at least 18, may enter a binding contract, and will provide accurate information. You are responsible for activity under your account.

3. Products and Compatibility

We strive for accurate descriptions, images, and pricing but may correct errors or modify products. The customer is responsible for verifying compatibility with the vessel, dock, lift, water pressure, and installation environment before purchase.

4. Pricing and Payment

Prices are in U.S. dollars and may change without notice. The price shown when the order is placed is final. By submitting payment, you authorize the full order total, including applicable taxes, shipping, and displayed fees. We may cancel orders affected by pricing errors or suspected fraud.

5. Order Acceptance and Cancellation

An order is an offer to purchase. We may accept, modify, or cancel an order at our discretion. Customer cancellation requests made within 24 hours may be accommodated at our discretion. Processed, shipped, in-production, custom, or special-order products cannot be cancelled.

6. Shipping and Delivery

Delivery estimates are not guaranteed. We are not responsible for carrier, weather, customs, or other delays outside our control. Risk of loss passes when the order is delivered to the carrier. Inspect shipments immediately and report damage or incorrect items in writing within 72 hours of confirmed delivery.

7. Returns and Refunds

All sales are final once installed or used. Eligible unused returns require written authorization within 14 calendar days, are subject to a 25% restocking fee, and require the customer to pay return shipping. See our Return & Refund Policy.

8. Limited Warranty

Products are warranted against defects in materials and workmanship for one year from delivery under normal use and installation conditions. The warranty excludes improper installation, misuse, neglect, conditions beyond rated specifications, normal wear, unauthorized modifications, and installations contrary to applicable codes or manufacturer guidance.

Except as expressly stated, we disclaim other warranties to the fullest extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Lift Wash Systems is not liable for indirect, incidental, special, consequential, or punitive damages. Total liability will not exceed the amount paid for the product giving rise to the claim. The customer is responsible for safe, code-compliant installation and use.

10. Installation and Third-Party Services

Installation services are performed separately by SA Marine Services LLC under an independent service agreement. Lift Wash Systems is not a party to that installation agreement.

11. Intellectual Property

Website content, logos, product designs, images, and documentation belong to Lift Wash Systems or its licensors and may not be reproduced without written consent.

12. Prohibited Uses

Do not use the site unlawfully, attempt unauthorized access, transmit harmful or misleading content, interfere with operation, or resell products without authorization.

13. Disputes and Chargebacks

Before initiating a dispute or chargeback, contact Info@samarineservices.com and allow a reasonable opportunity to resolve the matter.

14. Governing Law and Venue

These Terms are governed by Florida law. Legal actions shall be brought in a court of competent jurisdiction in Broward County, Florida.

15. Force Majeure

We are not liable for delay or failure caused by events beyond our reasonable control.

16. Changes

We may update these Terms by posting a revised version. The version posted when your order is placed governs that transaction.

17. Severability

If a provision is unenforceable, the remaining provisions remain effective.
